QUESTIONS

Do I have to pay child support after my child turns 18?

My ex-wife is seeking to have a court order me to pay child support for my daughter even after she turns 18, which is in 6 months. I’ve paid regular child support, on time every month, since the divorce ten years ago. I’m ready to be done paying the support. The mother is telling me that I’m obligated to continue paying because our daughter has certain learning disabilities and special needs. I love my daughter and will always help her financially when she needs it but I don’t want to be ordered to continue to pay support to her mother rather than just directly helping her. Can I be required to pay the support beyond age 18?

QUESTIONS

Can I get a divorce and full custody based on domestic abuse?

I’ve been married for 15 years and my wife has been verbally and physically abuse to me for most of that time. I’ve never abused her because I don’t believe a man should abuse a woman. I’ve stayed in the marriage for our two kids, who are 10 and 12 years old. I thought it was best for them to have their mom in their lives but I no longer think it’s good for them to see this type of behavior in the home. Is it possible to get a final divorce and full custody of my children based on the domestic abuse? Is there going to be some favoritism toward her because she’s the mom? If I am able to file for divorce and custody based on her behavior, what do I actually need to provide to the judge to prove the abuse?

QUESTIONS

Can you get uncontested divorce in Texas if married in another state?

My marriage took place in Oklahoma and after we married, my spouse and I moved to Dallas. We separated after 6 months and have now been apart a year. We both want a quick, uncontested divorce. We’ve reached an agreement on all our property issues and we don’t have children together. Can we get the uncontested divorce in Texas if we were married elsewhere? If so, what do we need to provide to the court to finalize the divorce?

QUESTIONS

How to get emergency custody of my child in PA?

My 15 year old daughter had a major fight with her father and no longer wants to live or visit with him. My ex-husband and I currently have joint physical custody of her. I agree that she shouldn’t have to go back with him and am concerned that if she does, her physical safety may be in danger. Even if I did think she should go back to the shared custody schedule that’s in the court order, I don’t think she would do it and I can’t make a 15 year old go if she does not want to. How do I file for emergency custody of her? Will a judge allow her to testify in court about what happened and why she doesn’t want to see him?

QUESTIONS

What information can my adopted child get about bio family?

My husband and I adopted a son and he is now 12 years old. He has been asking about his biological family, especially his mother and father. We have told him everything we know about them, which is very little. We live in Los Angeles, under California law does he have the right to get information about his biological family? We want to support him in this and believe that at the very least, it would be good for him to know his medical history. If he is allowed to obtain this information, how do we go about helping him get it? Does his age matter such that if he can’t obtain it now, could he access it when he turns 18 or 21?
